Thank you for choosing the Noble App. By accessing or using the Noble App, you agree to be bound by these Terms & Conditions. Please review them carefully before proceeding.

NATURE OF BUSINESS:

The Noble App serves as a centralized marketplace platform specializing in sneakers and high-quality apparel, including streetwear and casual wear. We provide a curated selection of premium products from various vendors to offer our customers a diverse range of options in fashion and style. Whether you're seeking the latest sneaker releases or trendy streetwear essentials, the Noble App aims to be your go-to destination for elevated fashion experiences.

DELIVERY POLICY:

Delivery of orders through the Noble App is subject to availability, receipt of payment, and authentication procedures.

Shipping Time: On average, shipping may take up to 7 business days from the date of order confirmation. Please note that this timeframe is an estimate and actual delivery times may vary depending on factors such as location, courier efficiency, and unforeseen circumstances.

Fastest Shipping Provider: We are committed to providing you with the fastest shipping experience possible. Therefore, we utilize the fastest available shipping provider at the time of shipment to ensure timely delivery of your orders.

Authentication Process: Please be aware that all products must undergo authentication procedures before shipment. Upon receipt of orders, products are shipped to our warehouse for authentication from vendors. Once authenticated, they are then shipped out to customers.

Notification: Once your order has been processed, authenticated, and shipped, you will receive a confirmation email with tracking information to monitor the status of your delivery.

International Shipping: Please note that we do not cater to international orders. Any third party shipping partners are utilized at the customer’s own risk and Noble reserves the right to deny a user a refund in any case where a third-party shipping provider has been used outside of the Noble courier network provided.

Unforeseen Delays: While we strive to meet our delivery commitments, please understand that unforeseen delays may occur due to factors beyond our control, such as natural disasters or other external circumstances.

RETURNS, REFUNDS & EXCHANGES:

At the Noble App, we strive to ensure customer satisfaction with every purchase. Please
review our Returns, Refunds & Exchanges policy carefully.

Refund Policy:  **Refunds are subject to the discretion of the vendor. As a centralised marketplace, we facilitate transactions between customers and vendors. Therefore, refunds may only be provided if the vendor agrees or can assist in the refund process. Please see the Refunds, Returns and Exchanges Policy for more details. Refunds are subject to the discretion of the Noble App. As a centralised marketplace, we facilitate transactions between customers and vendors. Therefore, refunds may only be provided for if and when a support agent identifies valid reason to grant the refund and will be dealt with on a case-by-case basis.

Exceptions for Refunds: Refunds will be issued in the following circumstances:

Authentication Errors: If a product is found to be counterfeit or not as described during the authentication process, a full refund will be provided.

Incorrect Item Shipped: In the event that an incorrect item is shipped to the customer, a
refund will be issued upon return of the item.

Exchange Policy: Exchanges are facilitated based on vendor availability and discretion. Customers may request an exchange within the specified timeframe, subject to vendor approval.

Condition of Returned Items: Returned items must be unworn, undamaged, and in their original packaging with all tags attached. Items that do not meet these criteria may not be eligible for refunds or exchanges.

Process for Refunds & Exchanges: Customers must initiate a refund or exchange request through the Noble App's customer support within the specified timeframe. Our team will assist in coordinating the return process and communicating with the vendor on behalf of the customer.

Refund Processing Time: Refunds will be processed promptly upon approval from the case officer. Please allow up to [6-business days] for the refunded amount to reflect in your original payment method once the refund request has been granted.

CUSTOMER PRIVACY POLICY:

The Noble App is dedicated to safeguarding the privacy of our users and adheres to the Protection of Personal Information (POPI) Act in South Africa, ensuring compliance with data protection regulations.

Protection of Personal Information: The Noble App is committed to protecting user privacy and will take all reasonable steps to safeguard personal information in accordance with the POPI Act. 

Collection of Information: We may collect personal information from users during the registration process, order placement, or when voluntarily provided through interactions with our platform. This information may include but is not limited to name, contact details, shipping address, and payment information.

Use of Information: Personal information collected is used solely for the purpose of providing services, processing orders, and enhancing user experience on the Noble App. We do not share or sell user information to third parties for marketing purposes without explicit consent.

Data Security: We employ industry-standard security measures to protect user data against unauthorised access, alteration, disclosure, or destruction. This includes encryption of sensitive information and regular security assessments.

Access and Control: Users have the right to access, update, or delete their personal information stored on the Noble App. They may also opt-out of marketing communications or request the deletion of their account.

Third-party Services: The Noble App may utilise third-party services or integrations to enhance functionality, such as payment processing or analytics. Users are encouraged to
review the privacy policies of these third-party providers for transparency on data handling practices.

Consent: By using the Noble App, users consent to the collection, processing, and storage of their personal information as outlined in this Privacy Policy.

Updates to Policy: This Privacy Policy may be updated periodically to reflect changes in legal requirements or business practices. Users will be notified of any significant updates, and continued use of the Noble App constitutes acceptance of the revised policy.

PAYMENT METHODS: 

At the Noble App, we offer a variety of secure payment options to ensure a convenient and hassle-free shopping experience. Please find details regarding our accepted payment
methods below:

Credit/Debit Cards: We accept Visa, MasterCard, American Express, and other major credit/debit cards for seamless transactions.

Electronic Funds Transfer (EFT): Customers have the option to make payments via electronic funds transfer directly from their bank accounts. Bank details will be provided upon request.

Apple Pay: Enjoy the convenience and security of Apple Pay for quick and easy transactions using your Apple devices.

Google Pay: Make fast and secure payments with Google Pay, accessible through compatible Android devices.

Bank Transfers: Customers also have the option to make payments via bank transfer. Bank account details will be provided upon request. Additional Options: In addition to the above, we offer various other payment methods to cater to diverse customer needs. Peach Payment Gateway: We utilize Peach Payment as our trusted payment gateway to facilitate secure online transactions. Peach Payment employs industry-standard encryption and security measures to protect sensitive payment information. Convenience and Security: With Peach Payment, customers can enjoy the convenience of seamless transactions while having peace of mind knowing that their payment details are safeguarded against unauthorised access.


Payment Processing: Payments are processed promptly upon confirmation of orders. Customers will receive a confirmation email with details of their transaction once payment has been successfully processed.

Customer Support: If you encounter any issues or have questions regarding payment methods, our customer support team is available to assist you. Please feel free to reach out to us for prompt assistance.

RESPONSIBILITY:

The Noble App takes responsibility for all aspects of transactions, including goods and services, customer support, dispute resolution, and delivery.

VARIATION: 

The Noble App reserves the right to change these Terms & Conditions or any part thereof at any time without prior notice.

COMPANY INFORMATION: 

The Noble App is owned and operated by its respective company, registered as [The Noble App (PTY) LTD], with no physical location.

By using the Noble App, you acknowledge that you have read, understood, and agree to abide by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using the Noble App.

ADDITIONAL RIGHTS AND TERMS FOR APPS:

If you comply with the Terms, Noble grants to you a limited non-exclusive, non-transferable, revocable license, with no right to sublicense, to download and install the Apps on your personal computers, mobile devices, tablets, wearable devices, and/or other devices and to run the Apps solely for your own personal purposes. Except as expressly permitted in the Terms, you may not: (i) copy, modify or create derivative works based on any Apps; (ii) distribute, transfer, sublicense, lease, lend or rent any Apps to any third party; (iii) reverse engineer, decompile or disassemble any Apps (unless applicable law permits, despite this limitation); or (iv) make the functionality of any Apps available to multiple users through any means.

Additional Information: Apple App Store:

This section applies to any App that you acquire from the Apple App Store or use on an iOS device. Apple has no obligation to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the App purchase price to you (if applicable) and, to the fullest extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement and discharge of any third-party claim that your possession and use of the App infringe that third party’s intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. You represent and warrant that (i) you are not located in a country that is subject to a South African Government embargo, or that has been designated by the South African Government as a terrorist-supporting country; and (ii) you are not listed on any South African Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms of service, including these Terms, when using the App.

FEES:

Registering for the Service is free, but we charge certain fees based on various transactions on the Service. Our fee structure is outlined in our Fee Policy and is incorporated by reference into these Terms. We reserve the right to change, or discontinue, temporarily or permanently, some or all of such fees (including for promotional events), and such changes are effective when we post information about the changes through the Service. We may also change our Fee Policy at any time and in our sole discretion, and any changes to the Fee Policy are effective upon the posting of such changes to the Site or upon written notice to any user. Noble may grant fee discounts based on a rewards system or for promotional events which are subject to `noble’s discretion and may be halted, amended or altered at any stage and may be subject to availability.

SELLERS:

When submitting an item for sale on the App, you agree to our rules and policies for Sellers described in our Selling with Noble Policy and our FAQ, each of which are incorporated by reference into these Terms. You further agree that you have the legal authority to sell each item that you are submitting on the App and that the photos you may upload and the information you provide accurately reflect the item you send to us or the Buyer, as applicable.

BUYERS:

When buying an item on the App, you agree to our rules and policies for Buyers described in our FAQ and our Purchases and Returns Policy, each of which are incorporated by reference into these Terms. You further agree that you are responsible for reading the full item listing before making a decision to purchase an item. Noble is the seller of record for purchases made by buyers shopping from South Africa.

Listed items may remain in a Seller’s physical possession until a purchase is completed. For this reason, while we may help facilitate the resolution of disputes, and may provide assurances stated in our Assurance of Authenticity, we do not otherwise guarantee, to the fullest extent permitted by law, (i) the existence, quality, safety or legality of the items advertised; (ii) the truth or accuracy of Sellers’ representations; (iii) the ability of Sellers to deliver sold items; (iv) the ability of Buyers to pay for items; (v) that a transaction will actually be completed or that an item will be returned; or (vi) the legal transfer of an item from the Seller to the Buyer (or from Seller to Noble to Buyer).

In addition, there may be times when certain information contained on the App may be incorrect, incomplete, inaccurate, or appear inaccurate because of the browser, hardware, or other technology that you use. For example, we cannot guarantee that your computer monitor's display of any colour will be accurate. We reserve the right to correct errors or to update information at any time without notice. We have the right to refuse or limit any orders or quantities, extend the delivery timeline for any reason after the order has been placed and accepted, and/or refuse to ship an item to you for any reason. We will not be liable if an item is unavailable or if a shipment is delayed.

TERMINATION AND ACCOUNT CANCELLATION:

In the event of any breach of these Terms, Noble reserves the right to suspend or disable your Account or terminate these Terms applicable to you, at our sole discretion and without prior notice. We retain the right to revoke your access to and use of the Service and Collective Content at any time, with or without cause. While registering to join the App and creating an Account, you have the liberty to select any name to identify yourself to other Registered Users. Nonetheless, any complaints from Registered Users regarding your use of a false name may, at our sole discretion and without prior notice, lead to the suspension or disabling of your Account or the termination of these Terms. Should we terminate these Terms due to your breach, revoke your access to and use of the Service, or discontinue the Service and consequently these Terms, you will remain liable for all amounts due under these Terms. You may choose to cancel your Account at any time by reaching out to us.

SURVIVAL:

NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS, ANY PROVISION OF THESE TERMS THAT IMPOSES OR CONTEMPLATES CONTINUING OBLIGATIONS ON YOU OR NOBLE WILL SURVIVE THE TERMINATION OF THESE TERMS.

DISCLAIMERS:

By using the Service and relying on the Collective Content, you explicitly agree to do so at your own risk. The Service and Collective Content are provided “AS IS” and “AS AVAILABLE”, without any warranty of any kind, either express or implied. Without limiting the foregoing, Noble explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of trade. Noble makes no representation or warranty that the Service or Collective Content will meet your requirements or be available on an uninterrupted, secure, or error-free basis, that defects will be corrected, or that the Service is free of viruses or other harmful components. Noble makes no representation or warranty regarding the quality of any services, Collective Content, or anything else purchased on or obtained through the Service or the accuracy, timeliness, truthfulness, completeness, or reliability of any Collective Content obtained through the Service. Noble periodically amends, changes, updates, and alters the Service without notice. Noble assumes no liability or responsibility for any errors or omissions in the content of the Service. Noble specifically disclaims any duty to update the content of, or any other information on, the Service. No advice or information, whether oral or written, obtained from Noble or through the Service or Collective Content, will create any warranty not expressly made herein. Some jurisdictions do not allow the disclaimer of certain warranties, so some or all of the foregoing disclaimers may not apply to you.

INDEMNITY:

You agree to defend, indemnify, and hold Noble and its officers, directors, employees, agents, and representatives harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or Collective Content or your violation of these Terms. We reserve the right to assume all or any part of the defence of any such claims and negotiations for settlement, and you agree to fully cooperate with us in doing so.

INTELLECTUAL PROPERTY:

You acknowledge and agree that the Service and Collective Content may contain images and descriptions of fashion items and other content that are protected by copyright, trademark, or other laws of South Africa and foreign countries. Except as expressly provided in these Terms, Noble and its licensors exclusively own all rights, title, and interest in and to the Service and Collective Content, including all associated intellectual property rights. You agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, remove, obscure, or create derivative works based on any copyright, trademark, service mark, or other proprietary right contained on, incorporated in, or accompanying the Service or Collective Content.

All trademarks, service marks, logos, trade names, and other proprietary designations of Noble (the “Noble Trademarks”) displayed on the Service or Collective Content are trademarks or registered trademarks of Noble. Any other trademarks, service marks, logos, trade names, and other proprietary designations displayed on the Service or Collective Content may be the trademarks or registered trademarks of their respective owners. Nothing in these Terms should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any of the Noble Trademarks, without our prior written permission in each instance. All goodwill generated from the use of Noble Trademarks will insure to Noble’s exclusive benefit.

Subject to your compliance with these Terms, Noble grants you a limited, non-exclusive, non-transferable licence, without the right to sublicense, to access, view, and print any Collective Content solely for your personal and non-commercial purposes. You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, licence, sell, transfer, publicly display, publicly perform, transmit, or otherwise exploit the Service or Collective Content, except as expressly permitted by these Terms. No licences or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Noble or its licensors, except for the licences and rights expressly granted in these Terms. Any violation of the foregoing will constitute a breach of these Terms and may result in immediate termination of your right to use the Service.

ACCOUNT REGISTRATION AND SECURITY: To access certain features of the Service and to post any Registered User Content on or through the Service, you must register to create an account (“Account”) and become a “Registered User”. During the registration process, you will be required to provide certain information, and you agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy, currency, and completeness. If you have provided your phone number or email address during or after the registration process, you consent to us sending you security codes by text message or email to verify your identity as a Registered User. We reserve the right to suspend or terminate your Account for any reason at our discretion, including failure to provide certain information or to verify your identity when prompted, or if any information provided during registration or thereafter proves to be inaccurate, not current, or incomplete. You are responsible for safeguarding your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your Account, whether or not you have authorised such activities or actions. You will immediately notify us of any unauthorised use of your Account by contacting us.

HOW TO SUBMIT ITEMS FOR SALE WITH NOBLE:

To maintain quality and authenticity, we carefully select our sellers. If you're interested in becoming a seller, please navigate to the Sell tab on the app and complete the required information. Once you submit your request, we'll notify you once it has been approved.

APPROVAL PROCESS FOR SELLER ACCOUNT:

We value your interest in selling with Noble. Currently, we are approving seller requests for sneakers on an ongoing basis, with a limited number of slots available for apparel and accessories. This approach ensures that we can offer the best possible experience for our sellers.

SHARING SELLER ACCOUNTS:

Users are strictly prohibited from buying, selling, transferring, or sharing seller accounts. Any user found engaging in such activities may face suspension of their seller account.

CREATING MULTIPLE SELLER ACCOUNTS:

Each user is permitted to create only one seller account. Users discovered to have created more than one seller account may face suspension or permanent ban of their accounts.

HOW DO I EDIT MY SUBMISSIONS?
Tap the Sell tab, then tap Listings to select the items you’d like to edit. Once you’ve selected the items, you will be taken to your listing submission, where you can edit the size, condition, price. Please make sure to save your changes.

WHAT DO I DO IF MY PAYOUT IS INACCURATE?
At Noble we aim to provide timely payments to Sellers to ensure accuracy, validity and timeliness of payments in order to achieve maximum Seller satisfaction and capital liquidity. In the event that a Seller believes that they have been inaccurately paid, please email our support team through the ‘Contact Us’ feature and we will set it right.
